Gardeners Hampstead Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Hampstead provides gardening and related services to residential and commercial clients. By booking or receiving any service from us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Client means the person, company or organisation that requests or receives services from Gardeners Hampstead.
Services means the gardening, garden maintenance, soft landscaping, planting, lawn care, hedge cutting, garden clearance and any other related services provided by Gardeners Hampstead.
Visit means an individual attendance of our gardeners or contractors at the property to provide the agreed Services.
Contract means the agreement between Gardeners Hampstead and the Client for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation.
Property means the outdoor or garden area at the address where the Services are to be carried out.
2. Scope of Services
Gardeners Hampstead provides general gardening and maintenance services, which may include lawn mowing, edging, pruning, planting, border care, leaf clearance, garden tidy ups, soft landscaping, and related tasks as agreed with the Client at the time of booking.
The exact scope of work for each Visit will be set out in a quotation, booking confirmation, email confirmation or other written correspondence describing the Services to be delivered. Any additional work or changes requested by the Client that fall outside the agreed scope may result in additional charges.
All Services are subject to availability, seasonal conditions, site access, health and safety requirements, and any applicable regulations relating to gardening and green waste management in the service area.
3. Booking Process
3.1 Booking requests
Clients may request a booking by contacting Gardeners Hampstead through the available contact methods. At the time of the booking request, the Client should provide accurate details of the Property, required Services, approximate garden size, and any specific requirements or access restrictions.
3.2 Quotations
Where appropriate, Gardeners Hampstead will provide a quotation or estimated cost for the requested Services. Quotations are based on the information supplied by the Client and are valid for a limited period, which will be indicated in the quotation or otherwise reasonably implied. If the information supplied is incomplete or inaccurate, we reserve the right to adjust the quotation.
3.3 Acceptance of booking
A booking will be deemed accepted and a Contract formed when Gardeners Hampstead confirms the booking in writing or verbally and the Client accepts the quoted price, date, and time. Gardeners Hampstead reserves the right to refuse or cancel any booking at its reasonable discretion.
3.4 Site visits and assessments
For more complex projects, garden clearances, soft landscaping or ongoing maintenance contracts, Gardeners Hampstead may carry out an initial site visit or assessment before confirming the quotation. Any such visit will be arranged at a mutually convenient time.
4. Client Responsibilities
The Client agrees to provide Gardeners Hampstead with clear and safe access to the Property and all areas in which the Services are to be carried out. The Client must ensure that gates, pathways and relevant doors are unlocked or that appropriate access arrangements have been made.
The Client is responsible for informing Gardeners Hampstead of any risks, hazards or special conditions at the Property, including uneven ground, ponds, sharp objects, fragile garden features, cables, underground services, or any other relevant information that could affect the safe delivery of the Services.
The Client must ensure that children and pets are kept away from the working area for the duration of the Visit and that Gardeners Hampstead staff can carry out the work without obstruction or interference.
If Gardeners Hampstead is unable to gain access to the Property, or if the working conditions are unsafe, we may cancel or postpone the Visit and the Client may be charged a call-out or cancellation fee.
5. Pricing and Payment
5.1 Rates and estimates
Services may be charged on an hourly rate, a fixed price basis, or a per-project basis, as specified in the quotation or booking confirmation. Any estimates provided are based on the anticipated time and materials required, using the information supplied by the Client. If additional time or materials are necessary due to unforeseen conditions, extra growth, access difficulties or Client requests, Gardeners Hampstead may revise the price accordingly.
5.2 Payment terms
Unless otherwise agreed in writing, payment for one-off visits is due on completion of the Services on the day of the Visit. For regular maintenance contracts or longer projects, Gardeners Hampstead may require payment in advance, staged payments, or payment within a specified number of days of invoice.
The accepted methods of payment will be communicated to the Client at the time of booking or invoicing. All prices are stated in pounds sterling and are inclusive or exclusive of applicable taxes as indicated on the quotation or invoice.
5.3 Late payment
Gardeners Hampstead reserves the right to charge interest on late payments and to suspend or cancel future Visits until outstanding amounts have been settled. Any costs incurred in recovering overdue payments, including legal or collection fees, may be charged to the Client.
6. Cancellations and Amendments
6.1 Client cancellations
If the Client needs to cancel or reschedule a Visit, they should provide as much notice as possible. Unless otherwise stated in the booking confirmation or contract, Gardeners Hampstead may apply a cancellation fee where less than 24 hours notice is given before the scheduled Visit time, or where our gardeners attend the Property but are unable to gain access or commence work.
Regular maintenance clients may be subject to specific notice periods or minimum term provisions, which will be set out in the relevant agreement. Failure to comply with these provisions may result in cancellation charges.
6.2 Company cancellations
In some circumstances, Gardeners Hampstead may need to cancel or reschedule a Visit, for example due to severe weather, staff illness, access issues, safety concerns or other events beyond our reasonable control. In such cases, we will notify the Client as soon as reasonably practicable and arrange a new Visit time. Gardeners Hampstead will not be liable for any loss or inconvenience caused by such cancellations, but any prepayments for cancelled Visits will be applied to future bookings or refunded where appropriate.
6.3 Changes to Services
The Client may request changes to the scope of Services, garden areas covered, or service frequency. Gardeners Hampstead will consider such requests in good faith and confirm any revised pricing or schedule. If the changes are significant, a new quotation or contract may be required.
7. Waste Removal and Environmental Regulations
Gardeners Hampstead aims to manage green waste responsibly and in compliance with applicable local regulations and environmental requirements. The handling of garden waste will depend on the type of service booked and the arrangements made at the time of quotation.
Where waste removal is included, Gardeners Hampstead will collect and dispose of green waste generated by our work using lawful and appropriate methods. Any additional waste not generated by our Services, such as household rubbish, soil spoil, construction materials or hazardous substances, will not be removed unless specifically agreed and quoted in advance.
Clients may choose to keep green waste on site, for example in compost areas, designated bins, or garden waste containers, as agreed before or during the Visit. In such cases, Gardeners Hampstead will place the waste in the specified location but will not be responsible for subsequent disposal arrangements.
It is the Client s responsibility to provide accurate information about any materials or substances present in the garden that may require special handling, including contaminated soil, invasive plants or chemical residues. Any additional costs arising from the handling, treatment or disposal of such materials may be charged to the Client.
8. Health, Safety and Weather Conditions
Gardeners Hampstead takes health and safety seriously and will take reasonable care to ensure that work is carried out in a safe manner. Our gardeners may refuse to carry out any task that they consider unsafe or beyond the scope of our Services.
Adverse weather conditions, such as heavy rain, storms, snow or extreme heat, may affect our ability to deliver the Services safely or to the appropriate standard. Gardeners Hampstead reserves the right to postpone or adjust work in such circumstances. The Client acknowledges that certain gardening tasks are seasonal and that results can be affected by weather and natural growth patterns.
9. Liability and Insurance
Gardeners Hampstead will use reasonable skill and care in the provision of the Services. If the Client believes that any aspect of the work has not been carried out with reasonable skill and care, they should notify us promptly so that we may investigate and, where appropriate, rectify the issue.
While we take appropriate precautions, minor damage or disturbance may occur to turf, borders or other garden features as a natural consequence of gardening work. Gardeners Hampstead will not be liable for normal wear and tear or for deterioration caused by weather, pests, disease, or lack of subsequent maintenance.
Gardeners Hampstead shall not be liable for loss or damage arising from inaccurate or incomplete information supplied by the Client, hidden defects, underground cables or pipes not clearly identified, or the failure of any plants, turf or seeds due to factors beyond our control, including soil conditions, watering, weather or general care after the Visit.
To the fullest extent permitted by law, Gardeners Hampstead excludes liability for any indirect or consequential loss, loss of enjoyment, loss of profit, or loss of opportunity. Our total liability in respect of any claim arising out of or in connection with the Services shall not exceed the total fees paid by the Client for the specific Visit or project to which the claim relates.
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
10. Property and Belongings
The Client is responsible for securing any valuable items, garden ornaments, outdoor furniture, tools, toys, and other belongings before the Visit. Gardeners Hampstead will not be liable for loss or damage to items that have not been removed or adequately protected, except where caused by our negligence.
If our staff are required to move light items to carry out the Services, they will take reasonable care but shall not be held responsible for pre existing damage or for items that are particularly fragile or unsuitable for outdoor conditions.
11. Complaints and Disputes
If the Client is dissatisfied with any aspect of the Services, they should contact Gardeners Hampstead as soon as possible, ideally within 48 hours of the Visit. We will investigate the complaint and, where appropriate, arrange a follow up Visit, remedial work or another form of resolution.
Both parties agree to act in good faith to resolve any disputes promptly and amicably. If a dispute cannot be resolved through informal discussion, it may be referred to mediation or handled in accordance with the governing law and jurisdiction clause below.
12. Amendments to Terms
Gardeners Hampstead may update or amend these Terms and Conditions from time to time to reflect changes in our business practices, legal requirements or service offerings. The latest version will apply to new bookings from the date of publication or notification. For ongoing contracts, we will inform Clients of any material changes that affect their existing arrangements.
13. Governing Law and Jurisdiction
These Terms and Conditions, and any Contract between Gardeners Hampstead and the Client, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or any Contract, including any dispute relating to their existence, validity or termination.
14. Severability
If any provision or part provision of these Terms and Conditions is found by a court or competent authority to be invalid, illegal or unenforceable, that provision or part provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected.
15. Entire Agreement
These Terms and Conditions, together with any written quotation or booking confirmation issued by Gardeners Hampstead, constitute the entire agreement between the Client and Gardeners Hampstead in relation to the Services provided. The Client acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of Gardeners Hampstead that is not set out in the Contract.
